Updates to the exchange formulae

The Law Society is proposing far-reaching changes to the existing formulae for the exchange of contracts. The changes that are expected to be implemented in 2026 will replace the existing formulae for exchange of contracts with two new protocols, which will be compulsory for CQS firms. The proposals also involve regulating for the first time what is meant by “hold to order” in respect of both deposits and documents.
