Unfair dismissal – how much is the claim worth?

The Employment Rights Act 2025 will abolish the statutory cap on compensation for unfair dismissal. This will mean that awards made by employment tribunals may increase dramatically in the case of claimants who are high earners, or who face difficulty in the labour market because of age or disability. It will also place greater emphasis on the valuation of occupational pensions and the rules relating to grossing up of awards to reflect taxation.
