The RICS Code for Leasing Business Premises 1st Edition

Coming into force on 1 September 2020, this Code will replace the existing Code for Leasing Business Premises in England and Wales 2007.

This webinar highlights the differences between the old Code and the new Code, including in particular:

  • Although the old Code was entirely voluntary, some of the new Code provisions are mandatory for surveyors, and others constitute good practice (RICS members must justify any departure from good practice);
  • The old Code contained 10 separate provisions relating to drafting lease terms – the new Code contains 12.  There are entirely new provisions relating to the demised premises, management and operational performance, energy performance certificates and landlord’s title;
  • Substantial changes have been made to the provisions relating to:
    • Tenant break rights and options to renew;
    • Rent deposits;
    • Rent review;
    • Alienation;
    • Repair;
    • Alterations
