No-fault divorce procedure – developments since implementation date

Recorded on: 06/05/2022

The 6 April 2022 was a significant date for family practitioners with the implementation of the new no-fault divorce rules and changes to procedure. We now have new forms, as well as procedural guides which offer clarity on some of the unanswered questions before the implementation date.

This update to our March 2022 webinar on no-fault divorce  will cover the following matters in greater detail so that practitioners can work through the new law with confidence:

  • Contrast between the old and new online divorce process
  • Summary of the new procedural guides
  • Step-by-step look at the new forms and how they have changed
  • How to handle cases issued before 31 March 2022
  • President’s guidance on claiming costs under the new law
  • Ministry of Justice updated information as of April 2022
  • How to apply for alternative service and deal with issues over service
  • How the court will deal with application for extension to serve
  • How the s.10(2) defence will be used in practice
  • Effect of delayed service upon the respondent under the new law
