ICO Age Appropriate Design Code

Recorded on: 29/06/2021

The Age Appropriate Design Code (‘Children’s Code’) came into force on 2 September 2020 with a twelve month transition period that is due to end on 1 September 2021. The Children’s Code applies to ‘information society services likely to be accessed by children’. This means that many organisations will need to implement the requirements of the Children’s Code even though they do not specifically target their services towards children. Failure to comply will potentially lead to enforcement action under existing data protection rules.

This webinar summarises the key content and also considers what needs to be done in order to ensure compliance.

Topics for discussion will include:

  • Key definitions concerning applicability
    • ‘information society services’
    • ‘likely to be accessed by children’
  • Relationship with the UK GDPR’s parental consent requirements
  • Summary of 15 Design Standards including:
    • Best interests of the child
    • Age appropriate application
    • Default settings
    • Parental controls
    • Profiling
    • Nudge techniques
  • Enforcement
  • Applicability to non-UK service provides
