Family Law – The Key Case Law Developments of 2020

While much of 2020 has of course been dominated the impact of the pandemic, the fact that the courts have responded so well means that the law has continued to move on in several key areas of family law and practice. This session will provide an insight into the key developments that have occurred over the past year, in particular:

  • Cohabitation law – Constructive trusts in the wake of Amoutreuil v Amoutreuil & Anr [2020] EWHC 2068 (Fam), and the changes to costs budget rules
  • Financial remedies – Key cases such as FRB v DCA [No.2] 2020 EWHC 754 (Fam) on spousal misconduct, as well as changes to the costs rules.
  • Private and public children law – Issues around experts, following Re AV (A Child) (Expert Report) [2020] EWCA Civ 346, and parental alienation after Re S (Parental Alienation: Cult: Transfer of Primary Care) [2020] EWHC 1940 (Fam)
  • Marital breakdown – The position with religious marriages, following Her Majesty’s Attorney General v Nasreen Akhtar (1), Mohammad Shabaz Khan (2) (Respondents) and Fatima Mohammed Hussain and Southall Black Sisters (Interveners) [2020] EWCA Civ 122
  • Divorce and dissolution – The Divorce, Dissolution and Separation Act 2020
  • Injunctions and personal protection – The position with ‘open ended’ orders, following Manjra v Shaikh [2020] EWHC 1805 (Fam), and stalking protection orders
