Consumer Law Update

This course will focus on a number of recent developments in the field of consumer law. Topics will include:

EU New Deal for Consumers

The proposed new deal is intended to harmonize and strengthen consumers’ rights across the European Union. It will be implemented by way of updates to four existing EU directives and has a proposed implementation date of 2021.

Key provisions are as follows:

  • Improved on-line rights for consumers
  • Introduction of representative actions on behalf of consumers (no law firms allowed!)
  • Harmonization of enforcement in respect of unfair commercial practices
  • Fining powers of 4% of turnover as a minimum available to enforcement bodies

Unfair terms in consumer contracts

  • Examples of recent enforcement action
  • Summary of proposed changes to this area
