How to grow your new build conveyancing portfolio

Recent government figures have shown an increase in the number of new build homes being built in England. Robert Jenrick, Housing Secretary said: “The figures show that the number of new homes developers have started building have more than doubled compared to the previous quarter and the number of completed homes has almost tripled. This reflects the government’s commitment throughout the pandemic to support industry to enable construction sites to remain open and operate safely.

We extended planning permission deadlines and flexible working hours on sites so that builders, architects, and developers have been able to continue working while following public health advice. In turn, this has protected millions of jobs, from builders, through to estate agents and carpenters. The housing industry is key to our economic recovery, which is why we’re investing £12 billion in affordable housing, providing £400 million to build more homes on brownfield land, and investing £7.1 billion for a new National Home Building Fund over the next 4 years, unlocking up to 860,000 homes.”

New build conveyancing can be more complex than other types of conveyancing as the potential for something to go wrong can be much greater – issues like non-compliance with planning regulations, failure to arrange NHBC inspections, incomplete agreements for sewers and roads, failure to plan for the future maintenance of common parts of a development can all prove costly if not done correctly.

There are a number of searches relating to new build properties which must be undertaken before purchase as part of the new build conveyancing process. Some examples of these searches include: Checking that appropriate planning permission has been obtained and that the property has been constructed in full accordance with it, that roads are properly adopted, that drains and utilities are properly established, as well as obtaining results of other relevant local searches. It is also important to highlight any restrictive covenants that have been written into the lease or registered against the freehold as these could prohibit any alterations to the property.
