DG Legal: An Introduction To Judicial Review Proceedings

Following the challenges brought by Gina Miller and Joanna Cherry MP that culminated in the Supreme Court judgment in R(Miller) v The Prime Minister & Cherry and Others v Advocate General for Scotland [2019] UKSC 41 judicial review suddenly found itself thrust into the very forefront of the UK’s daily news cycles (at least for a day or so…). It also became the focus of political ire and a sudden overwhelming desire by the Government to reform what was considered to be an area of law in which “judges, enabled in part by the Human Rights Act, have expanded their reach into what some consider to be inherently political areas of decision making”.

So, what are these proceedings that Lord Faulks QC was tasked with reviewing? Is it a tool that simply enables lefty do-gooder lawyers to play the immigration system? Or is it an important tool that provides much needed protection for the citizen against state power, by ensuring that Government, and other public decision-makers are held accountable?
