The need for the court to construe Wills and trust shows no signs of slowing down; indeed, construction and rectification applications may well have increased since the law was comprehensively considered by the Supreme Court in Marley v Rawlings. Certainly, professional indemnity insurers continue to insist that such applications should be a disappointed party’s first port of call, rather than a negligence action. Such claims are not straight-forward, however, and in particular the evidence that is required and/or permitted in each case needs careful consideration.
